1. About these Terms and Conditions
I.
These terms and conditions regulate the business relationship between the customer and the company.
II. By using any part of ALL Talents you agree to be bound by these conditions of use.
III. If you do not wish to be bound by these conditions, you may not access or use this site.
IV. All goods and services sold through this site are in accordance with the distance regulations 2000.
2. Your right to return the products to us
A.
60 Day Return Policy (unopened)
ALL Talents operate a 60 day return policy: You may return the product(s) to us for a refund within 60 days. Such returns are
subject to payment of transportation charges (Please refer to clause 11) and provided the following conditions are met:
I.
You inform us of your decision to return the goods within 60 days (commencing the day after you receive the
goods).
II.
The product(s) are returned in their original packaging.
III.
All additional packaging originally used to send the product(s) to you is used to ensure the safe return of the product back
to us. THIS WILL BE YOUR ULTIMATE RESPONSIBILITY.
IV.
ALL Talents reserve the right to reject any product(s) that appear to have been used excessively. In such cases you are liable
to pay a re-stocking fee which will be 25% of the value of the items you wish to return.
V.
Your refund can only be processed once the product(s) have been returned back to us and checked by our staff to meet these
conditions.
VI.
You must follow the procedure detailed in clause 10. C) below.
B.
Change of Heart
If you simply changed your mind about a product(s) that you have received (having tried them), you may wish to return the
product(s) to us for a refund. Such returns are subject to payment of transportation charges (please refer to section 11) and provided the
following conditions are met:
I.
You inform us of your decision to return the goods within 60 calendar days (commencing the day after you receive the
goods).
II.
The goods are returned in their original packaging and good condition.
III.
With the product(s) will be enclosed any accessories, in box warranties and other materials supplied within the
box.
IV.
All packaging originally used to send the item to you is used to ensure the safe return of the product back to us. THIS WILL
BE YOUR ULTIMATE RESPONSIBILITY.
V.
The products are securely sealed.
VI.
You must follow the procedure detailed in clause 10. C) below.
C.
To ensure we can process your request efficiently and as quickly as possible:
Please contact our Customer Service department via email: admin@alltalents.co.uk to make arrangements for the return. Please make sure to
mention your order reference and the item/s which you wish to return for us to be able to deal with your query as quickly as
possible.
Our Customer Service Team will provide you with a returns number which must be securely attached to the outside of the
products(s) that you are returning.
You will be refunded the total cost of your order minus any transportation fees.

By following these procedures you will help to ensure that the product(s) arrive at the correct destination, in the condition
that they were sent and within a reasonable amount of time.
Please note that in the event you return a product that is damaged through misuse by you, or a product is returned outside the
reasons as in clause 10. B) with no fault found, any cost incurred by us will be payable by you.
For any products purchased through ALL Talents, ALL Talents must be your first ‘port of call’ for any warranty issues. If you
believe you have a warranty claim, please email our Customer service team at admin@alltalents.co.uk.
3. Warranties
A.
Guitars
All guitars and guitar packs are covered by a 5 year warranty.
For added peace of mind, ALL Talents quality checks every guitar we receive from our suppliers. We record serial numbers and
add additional packaging to these items to ensure their safety whilst in transit.
B.
Amplifiers
All amplifiers are covered by a 5 year warranty.
C.
Digital Pianos
All Digital pianos hold a 5 year warranty.
E.
Keyboards
I.
Yamaha keyboards hold a standard 2 year warranty.
II.
Casio keyboards hold a standard 2 year warranty.
III.
Korg keyboards hold a standard 1 year warranty.
IV.
Ketron keyboards hold a standard 2 year warranty.
V.
Gem keyboards hold a standard 2 year warranty.
VI.
Suzuki keyboards hold a standard 2 year warranty.
VII.
Roland keyboards hold a 3 year warranty.
F. Acoustic Pianos (new)
I.
Yamaha acoustic Pianos hold a 5 year standard warranty. (Disklavier and Silent pianos hold a 5 year warranty on all acoustic
parts and a standard 2 year warranty on electrical parts/products).
II.
Bohemia acoustic pianos hold a 5 year warranty.
III.
Klima acoustic pianos hold a 10 year warranty.
IV.
Kemble Upright acoustic pianos hold a 5 year warranty and Kemble Grand pianos hold a 10 year warranty.
V. Classenti pianos hold a 15 year warranty
VI. All Acoustic pianos, not listed above hold a 5 year warranty for Upright pianos and a 10 year warranty for Grand
pianos.
G.
Drums and Cymbals
I.
All drums are covered by a 5 year warranty, which includes a standard 1 year manufacturers warranty plus an additional 1
year warranty from ALL Talents.
II.
Cymbals hold a standard 1 year warranty.
H.
Woodwind and Brass
I.
All Woodwind and Brass instruments are covered by a 5 year warranty, which includes a standard 1 year manufacturers
warranty plus an additional 1 year warranty from ALL Talents.
I. String Instruments
I.
All string instruments are covered by a 5 year warranty. In the case that your product/instrument becomes defective, some instruments manufacturer will require that the product is
checked and tested before issuing a replacement. Please note: strings are not covered under the warranty.
ALL Talents is not able to replace these instruments before inspection or necessary testing has been completed.
All other products with the exclusion of Classenti (other than those of perishable nature, including, without limitation,
strings, plectrums, bows, reeds, ligatures, mouthpieces, rosins, cleaning materials and care kits, drumsticks, straps, cables) featured on
ALL Talents carry a 1 Year Warranty.
FOR CONSUMERS, THIS WARRANTY IS IN ADDITION TO YOUR STATATORY RIGHTS.
ALL Talents is not liable to costs of telephone calls you make to us at national rates regarding warranty issues. We recommend
that all warranties are notified to us by email at admin@alltalents.co.uk or in writing by post
(please refer to clause 15.)
4. Placing Your Order
I.
When you place your order, ALL Talents will send you an email confirming the receipt of your order.
II. Payment for the products you have ordered will be taken when we despatch your order.
III. Once your order has been checked by us, we will send you a confirmation by email, which will include your order reference
number and estimated shipping times for the product(s) you have ordered. Shipping times are an indication of when your order will leave our
warehouse. This does not constitute a delivery day or date with you.
IV. ALL Talents will endeavour to process your order within 1 Business day.
V. You will receive confirmation that your products have been shipped upon dispatch from our warehouse by email. Your dispatch
email will also include a tracking number so you can check the progress of delivery with our chosen courier.
5. Prices and Availability
I.
The price you will pay for the products you have ordered will be set at the time your order is received by us.
II. All prices are inclusive of VAT.
III. Due to the number of products sold by us, there may be an occasion where a product is mis-priced. However, all items are
checked for the correct price when your payment is checked by us.
IV. Although we make every effort to ensure supply of the products listed on your order confirmation to you, there may be
occasions where this will not be possible because of (but not limiting to), (i) Products are no longer available for sale by the supplier
or not being manufactured or (ii) if there is a pricing error on the ALL Talents web-site. Should this be the case we will endeavour to
contact you as soon as possible and may suggest an alternative for you to purchase. If an alternative is not applicable then we will cancel
your order for those products which cannot be supplied and refund you any money that you have paid in respect to these products.
V. Repayment of such monies will be the extent of our liability to you, if the products you have ordered cannot be
supplied.
VI. The availability for products sold by us can be found on our website. ALL Talents cannot be more specific about availability,
other than the information that is displayed on our site.
Dispatch times are estimates. Although we cannot guarantee when a product/s will be dispatched we endeavour to give you the best information
possible and dispatch the items at the earliest. If you are unsure about when an item will be delivered to you, you can track the progress of
your order by checking your dispatch email or by contacting our Customer Service Department via email: info@alltalents.co.uk or use the online chat section of our website. For the quickest response
please use the online chat.
VII. As your order is processed we will inform you if any products you have ordered are unavailable.

III. Please note that ALL Talents cannot accept Visa Electron as method of payment for online of phone transactions. This form of
payment can only be authorised with a signature at the point of payment and can only be accepted in our stores and showrooms.
IV. You may give your card information to us on the phone or over the internet, using our secure on-line system only.
V. Please do not send us your bank or payment details by way of fax, post or email for security reasons. ALL Talents cannot be
held liable for any damages incurred due to disclosure of information using the above-listed means.
7. Delivery of goods
I.
All Goods are sold new and sealed in their original packaging as sent by the supplier, unless stated otherwise, either by the
website, or by any of our representatives on the phone, email or chat.
II. ALL Talents reserves the right to enforce quality checks on any products it might find susceptible to be damaged in transit.
ALL Talents will add protective packing material and re-seal any product that passed a quality check satisfactorily and add a quality
assurance certificate to any such product.
III. ALL Talents will use only reputable courier companies to deliver goods to you.
IV. Once an order has been dispatched from us, it is usually delivered the next working day (unless you have requested your
delivery to be upgraded as in clause 6. VI., or live outside mainland UK, including Isle of White and the Scottish Isles). If your order
contains more than 1 item, we may deliver such products on different days.
V. As your order will be delivered to you buy courier, ALL Talents cannot commit or guarantee to delivery times, standard
delivery times are between 9am and 5pm, Monday to Friday.
VI. You can upgrade your delivery to a premium service, i.e. before 9.00am, 10:30am or 12.00 noon. Weekend deliveries are also
available, please contact our customer serive department to inquire about the relevant costs should you wish to upgrade your
delivery.
VII. Unless stated otherwise on your order confirmation, all products sold are flat packed and larger items such as Digital Pianos
will require assembly. Please note that for safety reasons due to the size and weight of these products, we recommend that 2 people
assemble all Digital Pianos.
VIII. Deliveries of heavy items are made to ground level ONLY. We can arrange delivery upstairs or steps upon request at additional
cost. The responsibility of informing us that a heavy item should be delivered to any floor other than the ground floor is the customer’s.
Please note that the courier might refuse to deliver a heavy item to any floor other than the ground floor. ALL Talents is not liable to
any additional costs incurred due to the customer’s failure to notify the company of the need to deliver to any floor other than the ground
floor. In such cases, the customer will be liable to all additional costs incurred by the courier, the customer or the
company.
IX. WE STRONGLY ADVISE THAT YOU GAIN ASSISTANCE WITH HEAVY ITEMS, OUR COURIERS WILL ONLY DELIVER TO YOUR FRONT DOOR AS THIS IS THE
EXTENT OF THEIR INSURANCE AND RESPONSIBILITIES.
8. Passing of Risk
Ownership and risk of the products ordered will be passed onto you upon signature for delivery.
9. Damaged on Delivery and Missing Goods
Upon Delivery, you must inspect the condition of the items you receive (including their packaging).
If the packaging is in any way damaged you must sign for delivery of such goods as ‘DAMAGED’.
Notification must also be given to ALL Talents at the earliest opportunity - or in any case within 24 hours - (such
notification can be sent by mail, email or fax, or by phone).
Failure to do so could result in the delay of our Customer Service team resolving any situation and/or offering suitable
remedies in the quickest possible time.
In the unlikely event that the goods inside the packaging are damaged upon arrival by our couriers, please REJECT the delivery
and inform ALL Talents at the earliest opportunity or within 24 hours.
IT IS IMPORTANT THAT YOU CHECK THE CONDITION OF THE PACKAGING AND YOUR GOODS BEFORE SIGNING FOR THE GOODS AS IN SATISFATORY
CONDITION. FAILURE TO DO SO MAY RESULT IN DELAYS OF PROCESSING ANY CALIMS YOU MAY WISH TO RAISE IN REGARDS TO THE CONDITION IN WHICH YOU
RECEIVED THE GOODS (Please refer to clause 8).
10. Transportation Costs
(Please note that the following clauses relate to UK Mainland transportation only. Returns from outside UK mainland will be
dealt with on a case by case basis as shipping costs may vary. If such cases apply to you, please email our Customer Service team
at: admin@alltalents.co.uk to obtain a quotation).
If you were supplied a product in error, it is faulty or you have missing parts and you believe that you are entitled to a
refund, repair or replacement, please contact our Customer Services team via email: admin@alltalents.co.uk. The return of products for such reasons will not incur any of the above
Transportation Costs.
11. Refunds and Cancellations
ALL Talents will endeavour to process all refunds as quickly as possible. Please note that busy periods can delay such
processes but all refunds will be complete within 5 working days of cancelling or reporting returns (This is in accordance with
the Distance Selling Regulations, 2000).
ALL Talents reserves the right to refuse cancellation of any item ordered and/or specifically for the demand of the customer,
including (but not limiting) guitars built in custom shops, items that are not usual production line, personalized items, in accordance to
the Distance Sales Regulations, 2000.
12. Liability
A.
These terms and conditions explain our total liabilities and obligations to you in supplying goods.
ALL Talents is not liable for any warranties, conditions or other terms that are contractually binding that are not mentioned
in these terms and conditions.
Any warranty, condition or other term relating to the products you have purchased which may otherwise be implied or
incorporated in the contract stature, common law, laws applicable in the country where you purchased the product(s) (Including products,
quality, fitness for purpose and reasonable care) are exempt to the highest degree permitted by law.
In particular ALL Talents is not responsible, in any way for ensuring that the products are suitable for your
purpose.
B.
This contract will not limit in anyway our liability for death or personal injuries caused by (by not limited to): negligence,
fraud, any breach of the obligations applied to compulsory national law or any liability which cannot be excluded by law.
Subject to this clause ALL Talents is not liable under this contract for any loss of income, loss of profits, loss of data or
for any indirect loss or damage of any kind arising, whether caused by tort (including negligence), breach of contract or
otherwise.
Subject to this clause in respect to the product(s) you order, ALL Talents shall not be liable for any monies exceeding the
amount paid by you to us for the products you have ordered, whether through neglect or for any other reason.
ALL Talents contains links to other internet web-sites. We have neither power nor control over any such websites. You
acknowledge and agree that we are not liable in any way for the content of any such linked website, nor for any loss or damage arising from
your use of any such link.
This does not affect your statutory rights as a consumer, or the right to return the products as described in section
10.

14. Exporting Goods
You agree to comply with all Export Laws.
You agree to pay any import tax required by you when applicable.
You agree that should any product require permission to be exported in accordance with any Export Law, that you will get
permission and/or obtain an Export Licence should it be required that you do so.
You acknowledge that you are not located in, under the control of, or a national resident of any county to which export of the
products is prohibited by Export Law.
15. Security
You agree that you will not, and will not allow any other person to, violate or attempt to violate any aspect of the security
of the website.
You agree that you will in no way modify, reverse engineer, disassemble, decompile, copy or cause damage or unintended effect
to any portion of our website, or any software used on our website.
By accepting these conditions you understand that any such violation is unlawful in many jurisdictions and that any
contravention of law may result in criminal prosecution.
Examples of are violations are including (without limitation):
I.
Accessing data unlawfully or without our consent.
II. Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication
measures.
III. Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading,
"flooding", "mail bombing", "hacking" or "crashing".
IV. Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.
V. Taking any action in order to obtain services to which you are not entitled.
By accepting these conditions you agree to indemnify us against any claim or demand, including reasonable lawyers' fees, made
by any third party due to or arising out of:
I.
Any violation of system security as set out above.
II. Your use of Our Web Site.
III. Any other breach or violation of this agreement by you.
IV. The infringement by you, or by any other user of the services using your computer, of any intellectual property or other right
of any person or entity, or as a result of any threatening, libellous, obscene, harassing or offensive material contained in any of your
communications.
16. Circumstances beyond our reasonable control (Force Majore)
ALL Talents will make every effort to perform our obligations under this contract. However, we can not be held responsible for
any delay, failure to perform if such delay or failure is caused by any circumstance.
17. Payment Security
All credit card numbers are encrypted when the order is placed using 512 bit encryption. They are only decrypted after they
reach our computer and are not held in clear text on any website.
18. Disagreements, Governing Law and Jurisdiction
I.
ALL Talents will try to solve any disagreements quickly and efficiently and endeavour to reach an agreeable remedy.
II. If for any reason you are not happy with the way ALL Talents conducts its business and you would like to take court
proceedings, you must do so within the UK and English Law will apply.
19. Terminology
"Conditions"
These terms and conditions.
"Website"
The website located at the address www.alltalents.co.uk
"You/r"
The person using this website and its services, also referred to as a "The Customer" or "The User".
"Us"
ALL Talents, also referred to as "our", "we", "The Company" or "ALL Talents".
"Product/s"
The product that are for sale on the website, also referred to as "Item/s" and "Goods".
"Order/ed/s"
Your request/s to purchase products featured on the website.
"Order Reference Number"
The unique reference number you will be given to identify your every order you place with us.
"Dispatch/ed"
The point at which your product/s are packed, allocated a consignment number and ready to be delivered to your address from our warehouse by the
courier.
"Courier"
A third party delivery company which ALL Talents use to deliver your ordered products to you.
"Premium Service"
An optional upgrade when available (at additional cost) to deliver your product/s to you outside standard delivery times or services which invove
specific requirements.
"Flat Packed"
Products which are shipped unassembled. Those will require assembly by you before they can be used.
"Ground Floor"
The level or story of the house or property to which products are delivered which is the same level as street level.
"Chat"
A form of communication with us, via an on-line chat service available on our website.
"Seal/s"
Sticky tape or sticker/s used to protect the products in their original box, to ensure they are not opened or used.
"Standard Warranty"
The guarantee ALL Talents will collect, repair and return any product at no extra cost to you, if within the warranty period granted by the
manufacturer and/or supplier.
20. Rental Terms and Conditions
1. PHYSICAL CONDITION OF INSTRUMENT
Renter acknowledges that Renter has examined and is aware of the condition of
the Instrument and that it is in good condition except for any defects noted on this rental contract. It is the responsibility of the
Renter to return the Instrument to All Talents in the same condition as it exists at the time of delivery, except wear and tear. Pianos
will be tuned in the residence set forth of the front of this Rental Contract by All Talents within three (3) to four (4) weeks after
delivery. Renter is responsible for piano tuning at least once a year after the Instrument has been delivered to Renter. Instruments may
only be tuned or serviced by All Talents, and may not be tuned or serviced by any other company or individual, except tuning in the case of
violins and guitars. If the Renter requires tuning more than once a year, All Talents will tune the piano at the lowest prevailing
rate.
2. DELIVERY REQUIREMENTS
Renter must clear and prepare the delivery location and the means of access to
receive delivery of the Instrument. Delivery involving extraordinary access or conditions (for example, over railways, stairways, lofts,
marble or hardwood floors, etc.) shall be made at Renter’s sole risk and expense. Furniture and other items removed by All Talents shall be
moved at the Renter’s risk. All Talents shall have no liability for any delays in delivery. Notwithstanding anything to the contrary
contained herein, All Talents reserves the right to cancel this Rental Contract if All Talents determines that the intended location of the
Instrument in the residence or the means of access to the delivery location is unacceptable to All Talents, as it sole
discretion.
3. USE OF INSTRUMENT
Renter agrees that the Instrument will be used only at the residence set forth
on the front of this Rental Contract, and only for the purpose for which it was intended. Renter may not sublease or improperly use the
Instrument. Renter may not move the Instrument from its original location. If Renter desires to move the Instrument, only All Talents shall
move the instrument, which shall at the expense of the Renter.
4. RESPONSIBILITY FOR INSTRUMENT
Renter acknowledges that from the time the Instrument is delivered until it is
returned, Renter is responsible for the Instrument. Renter agrees to exercise due and proper care in reuse and maintenance of the
Instrument. If the instrument is lost, stolen, vandalised, destroyed or damaged prior to being returned to All Talents, regardless of
fault, Renter is responsible for all damages, including, but not limited to, the costs to replace or repair the instrument. In the event
the Instrument is not clean when returned, Renter shall pay All Talents a cleaning charge. Renter agrees to notify All Talents immediately
if the instrument does not function properly. No refund or allowances will be made by All Talents unless All Talents receives such
notification and has had an opportunity to inspect the Instrument.
5. INSTRUMENT FAILURE
Renter agrees to notify All Talents immediately if the instrument becomes
inoperable for any reason. All Talent’s discretion, to make the Instrument operable within a reasonable time, provide Renter with a like
instrument if available, make a like instrument available at another time, or adjust the rental rate. The provisions of this paragraph do
not relieve the Renter from the obligations imposed by the other paragraphs, including, but not limited to, Paragraphs 3, 5 and 6. In all
events, All Talents shall not be responsible for any loss or damage including, but not limited to, consequential damage resulting from
failure or defect of the Instrument.
6. RETURN OF THE INSTRUMENT
One month’s notice of termination must be provided in writing to All Talents.
If the contract is terminated before the minimum rental term has expired, renter is liable for payment of the remaining rental term. Upon
termination of this Rental Contract for any reason whatsoever, Renter agrees to cooperate in the return of the Instrument during All
Talents normal delivery and pickup days, within the hours 9:00a.m. and 5:00p.m. Monday to Friday, or 9:00 and 5:00 p.m. on a Sunday,
without specified times, or pay an out of hours collection charge of up to fifty pounds (£50.00). Renter acknowledges that if inaccurate
access information is given it could delay collection and may incur additional charges.
7. CHARGES AND PAYMENT
Renter is responsible for rental charges and all sales and use taxes thereon
from the time the Instrument is delivered until it is returned to All Talents. Instruments rented for part of a billing month shall be
charged for at daily rates. No refunds will be made for any period after the Instrument is returned to the All Talents. If any rental
charges are not paid within ten (10) days of the date due, All Talents is authorised to charge late rental and a late charge to Renter’s
credit card. Renters authorises All Talents to charge any other debt incurred by Renter to Renter’s credit card. In accordance with clause
11.
8. RENTAL ONLY
This Rental Contract is not a sales contract and does not give the Renter any
right to purchase the Instrument. However should the renter wish to purchase instrument this may be arranged upon the 6th month of rental,
at this point the renter may allow a discount equal to 6monthly rental contributions. After a period of 12months the discount is equal to
9months rental contributions, and shall remain so for the duration of the rental thereafter. The Instrument is and shall remain the
property of All Talents, until such a time as the instrument is purchased in full as per the terms of this contract. Renter shall not
remove any identification tags which are attached to the Instrument. Renter has only the right to use the instrument so long as this Rental
Contract has not terminated and the Renter is not in default hereunder.
9. PROHIBITION OF TRANSFER OF RENTER’S INTEREST
Renter shall not sublease, rent, assign, or grant a security interest in, or
otherwise transfer the Instrument.
10.
INSPECTION
Renter agrees to allow All Talents to inspect the instrument at any reasonable
time.
11.
LATE CHARGE
If Renter fails to make a monthly payment in full within ten(10) days after it
is due, Renter shall pay a late charge in the amount of five percent (5%) of the part of the payment that is late.
12.
DEFAULT
If the Renter is in default of any of the terms and conditions of this Rental
Contract, All Talents, in order to enforce its ownership rights in the Instrument and to protect its interest in this Rental Contract, may
take possession of the instrument without judicial process and to do so, All Talents or its representatives, may enter Renter’s property
and Renter hereby waives any right or action against All Talents for such entry and retaking. In addition, Renter acknowledges that the
failure to return, or the conversion or concealment of, the Instrument, is prohibited and such action may constitute a crime. In such event
All Talents, in addition to any other action it is entitled to take, may notify all authorities and take such other action, including, but
not limited to, the filing of criminal complaints. In the event of default by Renter, Renter agrees to pay All Talents legal fees,
collection fees, court costs and any other costs and expenses incurred by All Talents in collecting any amounts due under this Rental
Contract including, but not limited to, all costs associated with the retaking of the instrument or otherwise enforcing the terms of this
Rental Contract.
13.
MISCELLANEOUS PROVISIONS
Renter warrants the truth and accuracy of all information contained herein and
in all applications given to All Talents by Renter. This Rental Contract shall be governed by, and construed and interpreted in accordance
with, the laws of the United Kingdom. This Rental Contract contains the entire agreement of the parties hereto with respect to the rental
of the instrument, and no prior or contemporaneous representations, inducements, promises, or agreements, oral or otherwise, between the
parties not embodied herein shall be or any force or effect. This Rental Contract shall be binding upon and shall inure to the benefit of
the parties hereto and their respective heirs, executors, personal representatives, successors and assigns. No amendment to this Rental
Contract shall be binding any of the parties hereto unless such amendments is in writing and such amendment is executed by the parties
hereto. Time is of the essence of this Rental Contract, and every provision herein. If Renter is composed of more than one person, the
choices, designations, and other decisions of one shall bind all of the others, and all persons composing Renter shall be jointly and
severally liable for all obligations of Renter herein.
